Over 10,000 officials evaded criminal liability for failing to file asset declaration - NACP

Despite the entry into force on December 30, 2020 of the law of Ukraine reinstating criminal liability for intentional failure to file an asset declaration and intentional declaration of inaccurate information, more than 10,000 officials evaded liability due to a Constitutional Court ruling of September 27, 2020, the National Agency on Corruption Prevention (NACP) has reported.

According to the report, those who did not submit their declarations are former MPs, including Kostiantyn Zhevaho, Ihor Kononenko, Andriy Lozovyi, Andriy Shynkovych, and Ivan Vinnyk.

NACP recalled that the law establishing the criminal illegality of such an act has no retroactive effect (Part 2 of Article 5 of the Criminal Code of Ukraine). That is, if the provision of the law on criminal liability was not in force at the time a crime was committed, a person cannot be prosecuted in accordance with the provisions of such a law.

Law of Ukraine No. 1074-IX, reinstating criminal liability for intentional failure to submit an asset declaration and intentional declaration of inaccurate information, came into force on December 30, 2020.
