ECHR orders Ukraine to pay almost EUR 25,000 to two plaintiffs

Ukraine has lost two cases in the European Court of Human Rights (ECHR) on claims filed by Ukrainian citizens.

The court issued the relevant rulings on Thursday, according to Ukrinform's correspondent in Strasbourg.

In the case "Smilianska v. Ukraine," the ECHR found a violation of the European Convention on Human Rights concerning conditions of detention in a pretrial detention center, the sufficiency of grounds for detention and the failure to provide the necessary medical support.

In February 2011, criminal proceedings were instituted against Viktoria Smilianska on suspicion of drug trafficking, possession, and distribution. From January to November 2011, she stayed in the Kharkiv pretrial detention center.

The case is still pending before the court.

Therefore, the ECHR ordered Ukraine to pay the plaintiff EUR 10,000 in non-pecuniary damage.

In another case, "Melnyk v. Ukraine," the Court found a violation of the European Convention on Human Rights in respect of police misconduct and an ineffective investigation into this fact in Ukraine. In addition, the ECHR found the applicant's poor detention conditions at colonies in Korosten, Riakhiv and Bila Tserkva and coerced confession.

The applicant, Mykola Melnyk, was given a sentence on charges of involvement in a robbery that occurred in Kyiv in January 2007.

In June 2018, the applicant was released from prison after serving his sentence.

The ECHR ordered Ukraine to pay the applicant EUR 12,000 in respect of non-pecuniary damage, EUR 2,760 in legal costs and EUR 30 in postage.
