Klitschko suing Honcharuk and Bohdan

Kyiv Mayor Vitali Klitschko is suing the Cabinet of Ministers, Prime Minister Oleksiy Honcharuk and Head of the Presidential Office Andriy Bohdan over the decision to dismiss him as chairman of Kyiv City State Administration.

Respective administrative claims have been filed with Kyiv District Administrative Court, according to Radio Free Europe/Radio Liberty.

The report notes that in one of Klitschko's lawsuits, he demands that the government's decision to submit a motion for his dismissal to the president be recognized as unlawful and that a respective proposal from Honcharuk be canceled.

He argues his demands in the lawsuit by the fact that "Vitali Klitschko's powers as Kyiv mayor last five years and end no earlier than November 16, 2020. Thus, given the above provisions that no one other than the Kyiv mayor can be appointed head of Kyiv City State Administration, the powers of Vitali Klitschko as a legally appointed head of Kyiv City State Administration can also not be terminated earlier than November 16, 2020."

Klitschko filed his second lawsuit against Bohdan, stating that the latter, in his opinion, had exceeded power when he filed a letter to the Cabinet of Ministers, which served as the basis for the government's consideration of a motion to dismiss Klitschko as chairman of Kyiv City State Administration. Klitschko stressed in his complaint that such issues are the exclusive powers of the president and the government.

"By his actions, Andriy Bohdan most likely committed a criminal offense when, having exceeded power under the current legislation, he appealed to the Cabinet of Ministers. The Cabinet of Ministers took part in this offense and they will most likely try to involve the president in that. This could lead to illegal actions by the president, including because the president said he was ready to resign himself if he violated Ukrainian legislation. In order to prevent this situation, we filed respective lawsuits. We will continue to look into that. If we see enough grounds for appealing to law enforcement agencies, respective statements will be prepared in the near future," said lawyer Oleksiy Shevchuk, who represents Klitschko's interests in these cases.

The Cabinet of Ministers on September 4 agreed to dismiss Klitschko as head of Kyiv City State Administration. According to Honcharuk, the Cabinet of Ministers' decision will be submitted to President Volodymyr Zelensky, who will make the final decision.
