Court orders mother of soldier Dmytro Panchuk from Rivne region to return UAH 3.8 M to him

The mother of Ukrainian serviceman Dmytro Panchuk from the Rivne region must return about UAH 3.8 million that she received while her son was in captivity.

Panchuk’s lawyer, Vasyl Kharchuk, told this to Ukrinform, citing a court ruling.

“The court sided with Dmytro,” the lawyer said.

He explained that Panchuk’s mother must return more than UAH 3.8 million that she received while her son was held captive.

According to Kharchuk, the exact mechanism for returning the funds has not yet been determined, and the parties may agree on how this will be done. It could be repaid in a lump sum or in installments. If the defendant refuses to return the money, Dmytro has the right to apply to the enforcement service for compulsory execution.

Lawyer Alla Filatova, who represents Panchuk’s mother, also confirmed that the Rivne District Court partially satisfied the serviceman’s claim for the return of the funds. She noted that the initial claim was for a slightly higher amount than what the court calculated based on official documents, with a difference of about UAH 100,000.

“Although the court partially satisfied the claim, in fact it concerns almost the full amount (minus approximately UAH 100,000) that my client must return. We believe the court did not apply a specific legal provision governing these relations, namely Cabinet of Ministers Resolution No. 884,” Filatova said.

According to her, the court’s decision effectively treats the funds as the serviceman’s salary, which must be returned.

Filatova added that while the legal proceedings are ongoing, there remains a possibility of reaching a settlement agreement and resolving the family conflict. Therefore, the defense intends to file an appeal.

“Perhaps this situation will still be resolved outside the court process. Despite the court’s decision, an appeal will be filed,” she said.

She also noted that the claimant and the defendant have begun communicating directly, without their legal representatives.

As reported by Ukrinform, the mother of the released POW from the Rivne region, Dmytro Panchuk, who received about UAH 4 million in his salary during his captivity, is seeking to reach an amicable settlement.

The judge announced a break in the proceedings and scheduled the next hearing for April 3.

Cases similar to that of Dmytro Panchuk are not uncommon.

The conflict between Panchuk and his mother is described as a family dispute. The mother’s lawyer emphasized that she received the funds in accordance with the law, that there are no convictions or suspicions of fraud or other criminal offenses against her, and that she is open to a settlement in order to restore communication with her son. She also stated that media coverage of the case does not fully reflect the actual circumstances.
