Odesa port fails to win blaze damage lawsuit against Firtash’s company
The Odesa commercial seaport could not win a UAH 8.52 million lawsuit against Specialized Seaport Nika-Tera LLC, owned by the billionaire Dmytro Firtash, in compensation for damages incurred as a result of the partial destruction of a rented crane.
According to Dumskaya.net news website, the lawsuit was denied by Economic Court of the Mykolaiv region.
The abovementioned crane has been rented by Nika-Tera since in 2007. It’s price was stated at UAH 24.5 million.
On February 5, 2015, the crane was ablaze - its engine was damaged, and individual components and assemblies of the engine were burned down. The Odesa port claimed losses worth UAH 8.52 million, but the court rejected the claim by ruling that there was no evidence of violations of fire safety by the renter. In addition, Nika-Tera LLC provided documents on regular maintenance and inspection of the crane.
The company had insured the crane for 14.93 million via Salamander-Ukraine company. The court decided that the insurer should reimburse the losses of the Odesa port.
